We comply with the Privacy Act 1988 (Cth) (“Privacy Act”) and the applicable Privacy Principles in the Privacy Act when handling personal information, together with the General Data Protection Regulation (GDPR) to the extent it applies. The following Terms of Use constitute an agreement between Andrew Coles and Alysha Holder trading as Packing Light Photography ABN 92 623 645 487 (“we /us“) and you, a user of our website (https://www.packinglightphotography.com.au) (“Site”) (“Terms of Use”). These Terms of Use apply to your use of our Site at any time now or in the future. Please read through the following carefully. If you are a resident of a jurisdiction that requires a specific statement regarding release then the following applies: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” You hereby waive any provision in law, regulation, or code that has the same intent or effect as the aforementioned release. In addition to our obligations under the Commonwealth Privacy Act 1998 and any State based health records legislation (to the extend applicable), we also comply with all Australian Child Protection legislation to the extent applicable.

When you register with us and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from us. The agreement contained in these Terms of Use is governed by and construed in all respects in accordance with the laws of the State of Victoria Australia and the parties hereby submit to the exclusive jurisdiction of the courts of the said State of Victoria.

Assignment

You must not novate, assign or subcontract the agreement contained in these Terms of Use or any of its obligations herein without our prior written consent.

Force Majeure

You agree that we are not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, insurrection, riots, terrorism, crime, labour shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.

Severability

In the event that a provision of these Terms of Use is found to be unlawful, conflicting with another provision, or otherwise unenforceable, the agreement contained in these Terms of Use will remain in force as though it had been entered into without that unenforceable provision being included in it.
